商標(biāo)右上角的TM是什么意思

“TM”是“商標(biāo)”的英文“trademark”的縮寫，“®”是“注冊”的英文“register”的縮寫?！癟M”和“®”都起提示性作用，通常它們都出現(xiàn)在一些標(biāo)志的右上角或右下角，“TM”表明聲明該標(biāo)志是作為商標(biāo)使用，而“®”則表明該標(biāo)志已經(jīng)是注冊商標(biāo)，享有商標(biāo)專用權(quán)。

我國法律對(duì)®的使用有明確的規(guī)定，但對(duì)TM的使用和管理沒有規(guī)定，只要是經(jīng)營者想告知他人某標(biāo)志是其作為商標(biāo)使用的標(biāo)志，無論該標(biāo)志是否申請商標(biāo)注冊，都可以使用“TM”標(biāo)識(shí)。但必須明確的是，“®”作為注冊商標(biāo)特殊符號(hào)，只有在商標(biāo)正式注冊后才能標(biāo)注，否則就是假冒商標(biāo)，會(huì)受到處罰。帶“TM”標(biāo)識(shí)的商標(biāo)如果跟已注冊商標(biāo)相同或近似，則構(gòu)成對(duì)其他商標(biāo)侵權(quán)，也會(huì)受到處罰。還有，帶“TM”標(biāo)識(shí)的商標(biāo)如果不及時(shí)注冊，其他企業(yè)搶注了這個(gè)商標(biāo)，那么他人搶注的商標(biāo)正式注冊后，這家企業(yè)也不能再使用這個(gè)帶“TM”標(biāo)識(shí)的商標(biāo)，否則就構(gòu)成侵權(quán)。

商標(biāo)右上角的TM是什么意思

在中國，商標(biāo)上的TM也有其特殊含義，其實(shí)TM標(biāo)志并非對(duì)商標(biāo)起到保護(hù)作用，它與R不同，TM表示的是該商標(biāo)已經(jīng)向國家商標(biāo)局提出申請，并且國家商標(biāo)局也已經(jīng)下發(fā)了《受理通知書》，進(jìn)入了異議期，這樣就可以防止其他人提出重復(fù)申請，也表示現(xiàn)有商標(biāo)持有人有優(yōu)先使用權(quán)。用圓圈R，是“注冊商標(biāo)”的標(biāo)記，意思是該商標(biāo)已在國家商標(biāo)局進(jìn)行注冊申請并已經(jīng)商標(biāo)局審查通過，成為注冊商標(biāo)。圓圈里的R是英文register注冊的開頭字母。注冊商標(biāo)具有排他性、獨(dú)占性、唯一性等特點(diǎn)，屬于注冊商標(biāo)所有人所獨(dú)占，受法律保護(hù)，任何企業(yè)或個(gè)人未經(jīng)注冊商標(biāo)所有權(quán)人許可或授權(quán)，均不可自行使用，否則將承擔(dān)侵權(quán)責(zé)任。用TM則是商標(biāo)符號(hào)的意思，即標(biāo)注TM的文字、圖形或符號(hào)是商標(biāo)，但不一定已經(jīng)注冊（未經(jīng)注冊的不受法律保護(hù)）。TM是英文trademark的縮寫。
