新穎性

新穎性，是指該發(fā)明或者實用新型不屬于現(xiàn)有技術(shù)；也沒有任何單位或者個人就同樣的發(fā)明或者實用新型在申請日以前向國務(wù)院專利行政部門提出過申請，并記載在申請日以后公布的專利申請文件或者公告的專利文件中。

創(chuàng)造性

創(chuàng)造性，是指與現(xiàn)有技術(shù)相比，該發(fā)明具有突出的實質(zhì)性特點和顯著的進步，該實用新型具有實質(zhì)性特點和進步。

實用性

判斷要滿足下列條件：
